1. Automatically Collected Information
b) Health and Fitness Data: The Kinetic Corps. platform collects certain health and fitness data via the “Fitbit” API (“FB Data”) including age, gender, height, weight, steps, active minutes, calories and heart rate. This data is used to determine your avatar’s performance level in the Kinetic Corps. matches and may be used for recommending matches against other players on the platform. We will not use or disclose to third parties any such FB Data for any purpose, including marketing or advertising, without users’ permission.

Service Providers. From time to time, we may enter into relationships with third parties who provide services to us (e.g., data management and storage services or credit card processing services). In those circumstances, we disclose User Information that is necessary for such service providers to perform those services and require that they maintain the confidentiality of such User Information.
– In response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims;
If we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person or property;
– If we believe it is necessary to investigate, prevent, or take action regarding significant abuse of the Services’ infrastructure or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of information);
– If we are involved in a merger, acquisition, or sale of all or a portion of our assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.
The Application does not collect precise information about the location of your mobile device.
5. Public Information
If you identify any User Information as public, you are authorizing us to share such information publicly. For example, you may elect to make certain Shared Information (such as your username) publicly available. Also, there may be areas of the Services (e.g., message boards, discussion rooms, and other online forums) in which you are able to post information that will be available to all other users of the Services. By choosing to use these areas, you understand and agree that anyone may access, use, and disclose any information that you post to those areas.
You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at firstname.lastname@example.org.
8. Modifying and Deleting Your Personal Information
If you would like to modify or delete from our database any User Information you previously submitted to us, please let us know by accessing and updating your profile. Please note that any User Information that we have copied may remain in backup storage for some period of time after your request and that if you delete certain information you may not be able to order services in the future without re-submitting such information. Also, please note that we will maintain User Information in our database whenever we are required to do so by law.
9. Data Retention Policy, Managing Your Information
We will retain User Provided data for as long as you use the Services and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Services, please contact us at email@example.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Services to function properly.
We have implemented reasonable measures to help protect your User Information from loss, misuse, or unauthorized access or disclosure. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your User Information, we cannot guarantee its security.
The Services may contain links to other websites. We are not responsible for the privacy practices of any such other website and urge you to review such practices prior to submitting any information to such websites.
12. Children’s Privacy
We are committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children’s online activities and interests. The Services may not be used by children under the age of 13 without a parent’s express written consent. We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at firstname.lastname@example.org. We will delete such information from our files within a reasonable time.
